1. Agreement to Terms
By accessing, browsing, or using xenial.pro (the "Site") and the free HTML5 gaming services (the "Services") provided by the Xenial Team (the "we", "us", "our"), you (the "user", "you", "your") agree to be fully bound by these Terms of Service (the "Terms") and our Privacy Policy. If you do not agree with any part of these Terms or our Privacy Policy, you must not use the Site or Services in any way, shape or form.
We reserve the right to modify these Terms at any time. Revised Terms will be posted on this page with an updated "Last Updated" date, and your continued use of the Site after the revision takes effect constitutes your unconditional acceptance of the new Terms.

Harassing, abusing, defaming, threatening, bullying or otherwise harming other users of the Site, or engaging in any discriminatory, racist, sexist or offensive behavior.
Impersonating the Xenial Team, other users, or any third party (e.g., game developers, brand representatives).
Circumventing any security measures, terms of use or access restrictions associated with the Site or its third-party game content.
Posting or sharing any obscene, pornographic, violent or illegal content on the Site (including in comments or reviews).
5. Intellectual Property Rights
All content on the Site, including but not limited to HTML5 games, game graphics, text, logos, trademarks, images, audio, video and software, is the exclusive property of the Xenial Team or our licensed third-party content providers. All such content is protected by international copyright, trademark and other intellectual property laws and treaties.
Our trademarks, logos and service marks (including "Xenial" and "xenial.pro") may not be used in any way, for any purpose, without our prior written express consent.
You acknowledge and agree that you do not acquire any ownership rights, title or interest in any content, games or materials you access or use on the Site—all rights remain with the original owner or licensor.
6. Disclaimers of Warranties
THE SITE AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.
We disclaim all express and implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted, error-free, virus-free or lag-free operation of the Site and Services.
We do not warrant that the Site or Services will be available at all times, that gameplay will be uninterrupted, that the Site’s content is accurate, complete or up-to-date, or that any defects or errors will be corrected.
Your use of the Site and Services is at your sole risk. We are not liable for any damage to your device, loss of data, game progress or any other harm resulting from your use of the Site or Services.
7. Limitation of Liability
To the fullest extent permitted by applicable law, the Xenial Team shall not be liable for any direct, indirect, incidental, special, consequential or punitive damages arising out of or related to your use of or inability to use the Site and Services. This includes, but is not limited to, loss of profits, game progress, data, or any other intangible losses.
Our total aggregate liability to you for any claims, damages or losses arising out of these Terms shall not exceed $0 (zero) USD, as our Site and Services are provided to you entirely for free, with no financial consideration exchanged.
This limitation of liability applies even if we have been advised of the possibility of such damages, and it survives the termination of these Terms and your access to the Site.
8. Termination
We may terminate or suspend your access to the Site and Services at any time, without prior notice or liability, for any reason whatsoever, including but not limited to your violation of these Terms, fraudulent conduct, disruptive behavior or inactivity.
Upon termination, your license to use the Site and Services will immediately cease, and you must stop all use of the Site and its content. Provisions of these Terms that by their nature should survive termination shall remain in full force and effect (e.g., intellectual property rights, disclaimers, limitation of liability, governing law).
9. Third-Party Game Content
The Site includes HTML5 games and content provided by third-party licensors and game developers. We are not responsible for the content, quality, availability, accuracy or terms of use of such third-party games. Any disputes, issues or claims related to third-party game content shall be resolved directly with the relevant third-party licensor or developer.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States of America, without regard to its conflict of law principles. Any dispute arising out of or related to these Terms or your use of the Site and Services shall be submitted to the exclusive jurisdiction of the state and federal courts located in California, United States of America.
11. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Xenial Team with respect to your use of the Site and Services. These Terms supersede all prior oral or written agreements, understandings and representations between the parties regarding the subject matter herein.
